Terms and Conditions

These Terms and Conditions ("Terms") govern your access to and use of the TagMyKid mobile application, website, and related services (collectively, the "Service"). By registering for, accessing, or using TagMyKid, you agree to be bound by these Terms. If you do not agree, you may not use the Service.

1. Definitions

"TagMyKid" / "we" / "us" / "our" refers to TagMyKid (Pty) Ltd, a company operating in South Africa.

"User" / "you" / "your" refers to any individual who registers for or uses the Service.

"Child" refers to a minor (under 18 years of age) for whom a User has created a profile in the Service.

"Tag" or "QR Code" refers to the unique identifier assigned to a Child's belongings.

"Finder" refers to any person who scans a Tag or enters a Tag Code to report a found item.

2. Eligibility

You must be at least 18 years old to register for and use the Service. By using TagMyKid, you represent and warrant that you meet this age requirement and have the legal capacity to enter into these Terms.

3. Account Registration

To use the Service, you must create an account by providing accurate and complete information, including:

  • Full name and surname
  • Valid email address
  • Phone number
  • Password

You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.

4. Subscription and Payment

4.1 Subscription Plans

TagMyKid offers subscription-based access to premium features:

  • Monthly Plan: R59 per month
  • Annual Plan: R649 per year

4.2 Payment Processing

Payments are processed securely through Paystack. By subscribing, you authorize recurring charges to your chosen payment method.

4.3 Inactive Subscriptions

If your subscription becomes inactive (due to non-payment or cancellation):

  • Your Tags will no longer function for notifications
  • You will not receive Finder contact information
  • You may view existing Children and QR Codes but cannot add new ones

4.4 Cancellation

You may cancel your subscription at any time. Upon cancellation, your access to premium features will cease immediately, but you will not receive a refund for the current billing period.

5. Service Description

TagMyKid provides:

  • Unique QR Codes for labeling Children's belongings
  • A platform for Finders to report found items
  • Email notifications when items are found
  • WhatsApp integration for direct contact (active subscriptions only)

TagMyKid does not guarantee the return of lost items. The Service facilitates communication between Finders and Users but does not control the actions of third parties.

6. User Responsibilities

You agree to:

  • Provide accurate information when creating Child profiles
  • Maintain up-to-date contact information
  • Use the Service only for lawful purposes
  • Not share your account credentials with others
  • Respond promptly to Finders who report found items

7. Privacy and Data Protection

We collect and process personal information as described in our Privacy Policy. By using the Service, you consent to such collection and processing in accordance with the Protection of Personal Information Act (POPIA) and other applicable data protection laws.

Child Information: Only limited, non-sensitive information (first name, surname, school, grade) is visible to Finders. Full contact details are never disclosed to Finders.

8. Limitation of Liability

To the fullest extent permitted by law:

  • TagMyKid is provided "as is" without warranties of any kind
  • We are not liable for lost, stolen, or damaged items
  • We are not responsible for the actions of Finders or third parties
  • Our total liability shall not exceed the amount you paid for the Service in the 12 months preceding the claim

9. Intellectual Property

All content, trademarks, logos, and intellectual property associated with TagMyKid are owned by TagMyKid (Pty) Ltd. You may not reproduce, distribute, or create derivative works without our express written permission.

10. Termination

We reserve the right to suspend or terminate your account if you:

  • Violate these Terms
  • Provide false or misleading information
  • Engage in fraudulent activity
  • Use the Service in a manner that harms others or the Service

You may delete your account at any time through the app settings.

11. Changes to Terms

We may update these Terms from time to time. We will notify you of significant changes via email or in-app notification. Continued use of the Service after such changes constitutes acceptance of the revised Terms.

12. Governing Law

These Terms are governed by the laws of South Africa. Any disputes shall be resolved in the courts of South Africa.
